These Inficurex Terms of Service (the “Terms”) describe your rights and responsibilities when using the Inficurex online platform and services (the “Services”). Please read them carefully. By accessing or using our Services, you agree to be bound by these Terms.

1. Who These Terms Apply To

These Terms apply to all users of Inficurex, including:

  • Businesses: Organisations or entities that create and manage Inficurex accounts for their teams.
  • Authorised Users: Individuals invited by a Business to access and use the Services.
  • Care Recipients and Carers: Individuals receiving or managing care through Inficurex.

2. Agreement and Authority

By creating an account, purchasing a subscription, or using the Services, you represent that you have the authority to enter into these Terms on behalf of yourself or the Business you represent. If you are accessing the Services as an Authorised User, you acknowledge that your use is subject to these Terms and any additional policies set by your Business.

3. Using Inficurex

  • Eligibility: You must be at least 16 years old to use the Services.
  • Account Security: You are responsible for safeguarding your account credentials and for all activities under your account.
  • Acceptable Use: You agree to use the Services lawfully, comply with all applicable laws and policies, and not misuse or interfere with the Services.

4. Subscriptions and Payment

  • Subscriptions: Access to certain features requires a paid subscription for each Authorised User.
  • Payment: Fees are specified at checkout or in an order form and must be paid in advance. Fees are non-refundable except as required by law or stated in these Terms.
  • Non-Payment: If payment is overdue, we may suspend or terminate your access to the Services after reasonable notice.

5. Business Data and Content

  • Ownership: The Business owns all data and content submitted by its Authorised Users (“Business Data”). Inficurex is granted a limited license to use Business Data as necessary to provide, maintain, and improve the Services.
  • User Content: You retain ownership of content you submit but grant Inficurex a license to use it for service delivery and improvement.
  • Feedback: Any feedback or suggestions you provide may be used by Inficurex without obligation or compensation to you.

6. Third-Party Products

  • The Services may integrate with third-party products or services. Inficurex does not warrant or support these third-party products, and your use of them is at your own risk.

7. Privacy

  • Please review our Privacy Policy for information on how we collect, use, and protect your data.

8. Service Availability and Changes

  • We strive to keep the Services available 24/7, excluding planned downtime. We may modify, suspend, or discontinue Services at any time, with reasonable notice where possible.

9. Term and Termination

  • Term: These Terms remain in effect until your subscription or account is terminated.
  • Termination: Either party may terminate for material breach with 30 days’ notice if the breach is not remedied. Upon termination, your access to the Services ends, but certain provisions (like confidentiality and liability) survive.

10. Confidentiality

  • Each party agrees to protect the other’s confidential information and use it only as necessary to fulfill these Terms.

11. Intellectual Property

  • Inficurex retains all rights in the Services and related intellectual property. You are granted a limited, non-transferable license to use the Services as intended.

12. Limitation of Liability

  • The Services are provided “as is” and “as available.” To the extent permitted by law, Inficurex is not liable for indirect, incidental, special, or consequential damages arising from your use of the Services.

13. Indemnification

  • You agree to indemnify and hold Inficurex harmless from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

14. Modifications

  • We may update these Terms as our Services evolve. Material changes will be communicated via the website or email. Continued use of the Services after changes means you accept the new Terms.

15. General Provisions

  • Notices: Notices may be sent by email or through the Services.
  • Assignment: You may not assign your rights or obligations under these Terms without our consent.
  • Governing Law: These Terms are governed by the laws of the jurisdiction in which Inficurex operates.
  • Entire Agreement: These Terms, together with any referenced policies, constitute the entire agreement between you and Inficurex regarding the Services.
